What RERA Requires Developers to Disclose
Every RERA-registered project must disclose on GujRERA's portal: the sanctioned building plan and layout, carpet area of each unit type, number of floors and units, promised amenities with completion timelines, promoter's track record (including past project delivery dates), list of legal encumbrances on the land, and insurance details.
The carpet area disclosure is particularly important. Pre-RERA, developers frequently quoted 'super built-up area' (which includes common areas like lifts, lobbies, and staircases) inflating the saleable area by 20–35%. RERA mandates that transactions be priced on carpet area basis — the actual usable floor area within the four walls.
Your Rights as a RERA-Protected Buyer
As a buyer of a RERA-registered project in Gujarat, you have: the right to receive possession by the registered date; the right to receive compensation (interest) for any delay; the right to inspect the project site and construction progress at scheduled intervals; the right to all promised amenities and specifications; the right to a registered sale agreement before paying more than 10% of the property cost.
The 10% rule is critical: a developer cannot legally accept more than 10% of the property price as advance/booking amount without first executing a registered sale agreement. Any developer asking for more than 10% before registration should be treated as a red flag.
Defect liability: after possession, any structural defect or quality shortfall reported within 5 years must be remedied by the developer at no cost to the buyer.
How to Verify a Project on GujRERA
Visit gujrera.gujarat.gov.in → search by project name or RERA registration number. Verify: registration status (active, lapsed, or expired), registered possession date, promoter details, quarterly progress updates submitted by the developer, and any complaints filed against the project.
