NRI and OCI Property Rules — Advisory Guide

What NRIs and OCIs may buy

The RBI FAQ lists purchase of immovable property in India, other than agricultural land, farm house or plantation property, from a person resident in India, an NRI or an OCI as a permitted transaction. In practice that covers flats, bungalows, villas, penthouses, residential plots, offices and showrooms. The FAQ reserves prior RBI permission for other cases, for example most acquisitions by foreign nationals; it notes that citizens of certain neighbouring countries need RBI permission, a restriction it says does not apply to OCIs.

How to pay

Payment has to be received in India through banking channels: an inward remittance from any place outside India, or a debit to the buyer's NRE, FCNR(B) or NRO account. Traveller's cheques and foreign currency notes are not accepted. Keep the remittance and bank records; they matter later if you want to repatriate the sale proceeds.

Gifts and inheritance

NRIs and OCIs may receive residential or commercial property as a gift from a relative who is a resident, an NRI or an OCI. They may inherit property from a person resident in India, or from a person who acquired it in line with the foreign exchange law in force at the time. Agricultural land, farmhouses and plantation property cannot be received as a gift.

Selling and gifting property you own

Residential and commercial property may be sold or gifted to a resident, an NRI or an OCI. Agricultural land, farmhouses and plantation property may be sold or gifted only to a person resident in India.

Taking sale proceeds abroad

The RBI FAQ allows NRIs and PIOs to remit sale proceeds when the property was acquired under the foreign exchange law and paid for through eligible channels. For residential property, repatriation is restricted to not more than two properties, and agricultural land, farmhouses and plantation property are excluded. The FAQ also refers to remittance of up to USD 1 million per financial year for eligible categories under the Remittance of Assets Regulations, 2016. Your bank will ask for tax documentation; PIKORUA's repatriation and TDS guides explain the process.

Spouses and joint purchase

The RBI FAQ allows a foreign-national spouse of an NRI or OCI to acquire one immovable property, other than agricultural land, farmhouse or plantation property, jointly with the NRI or OCI spouse, subject to the conditions it sets out. Check the current conditions before you plan a joint purchase.

Common Questions

Advisory FAQ

Everything you need to know about buying property in Ahmedabad as an NRI — from FEMA rules to repatriation of funds.

Can NRIs buy property in India?

Yes. According to the RBI FAQ on purchase of immovable property (updated 6 April 2023), NRIs and OCIs may acquire immovable property in India other than agricultural land, farm house or plantation property, by purchase from a resident, an NRI or an OCI.

Can an OCI card holder buy property in India?

Yes, on the same footing as NRIs in the RBI FAQ: residential and commercial property may be bought; agricultural land, farmhouses and plantation property may not.

Can NRIs or OCIs buy agricultural land or a farmhouse?

Not by purchase or gift. The RBI FAQ excludes agricultural land, farm houses and plantation property from what NRIs and OCIs may acquire, and agricultural land they already hold may be sold or gifted only to a person resident in India.

How must an NRI pay for property in India?

Through Indian banking channels: an inward remittance from outside India, or a debit to the buyer's NRE, FCNR(B) or NRO account. The RBI FAQ says payment cannot be made by traveller's cheques or foreign currency notes.

Can an NRI take the sale proceeds out of India?

Subject to conditions. The RBI FAQ allows remittance where the property was acquired under the foreign exchange law in force and paid for through eligible channels; for residential property, repatriation is limited to not more than two properties. Tax and bank documentation apply, so plan the sale with a chartered accountant and your bank.
